StreamClipping AI Terms of Service

This English version is provided for convenience only. The legally binding text is the French version, published at streamclipping.ai/cgu (« Conditions Générales d'Utilisation », Version 8.1). In the event of any discrepancy between this translation and the French text, the French text prevails.

These Terms govern the use of StreamClipping AI(the "Service"), an AI-powered video clipping platform operated by StreamClipping, a French simplified joint-stock company (SAS) with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 107 353 054, registered office at 5 rue des Wallons, 75013 Paris, France.

1. Purpose

These Terms of Use set out the conditions of access to and use of the Service. They supplement the Terms of Sale, the Privacy Policy and, for participants in the paid clipping program only, the Clipping Program Terms.

Order of precedence. In the event of conflict, the following order applies: the Clipping Program Terms for anything concerning a Campaign (production, publication and payment of clips, and the rights granted for that purpose); the Terms of Sale for commercial matters (subscriptions, credits, prices, invoicing); the Privacy Policy for personal data; and these Terms for everything else.

No other document governs the use of the Service. Earlier versions, including the previous English Terms of Service, are superseded.

2. Description of the Service

StreamClipping AI is a SaaS platform that lets users import video content (uploads, or links to third-party platforms such as Twitch, YouTube and Kick, provided they hold the necessary rights); automatically generate short vertical clips using artificial intelligence (transcription, semantic analysis, virality scoring); add visual elements (animated subtitles, branding, hooks, dynamic effects); and schedule automatic publication to the social accounts the user has connected via OAuth.

3. Registration and access

Access requires the creation of an account with a valid email address. The user undertakes to provide accurate information and to keep it up to date. We may at any time require confirmation of the user's identity or age. The Service is strictly reserved for adults (18 or over). The user is solely responsible for the confidentiality of their credentials.

4. Free plan and paid plans

A free plan is available, subject to quota limits (15 minutes of processed video per month, publisher watermark on generated clips). Paid plans unlock higher quotas and additional features, as set out in the Terms of Sale.

5. User undertakings

The user undertakes to use the Service fairly and for its intended purpose. In particular, the user shall not: upload, generate or distribute unlawful content or content infringing third-party rights (copyright, image rights, privacy, trademarks); publish child sexual abuse material, hate speech, harassment, or incitement to violence or terrorism; circumvent quota, rate-limiting or anti-fraud mechanisms; resell, sublicense or reverse-engineer the Service; use the Service to generate spam or misleading content (harmful deepfakes, fake news) or to harm third parties; overload or disrupt the infrastructure; or impersonate a third party or use an account that is not theirs.

Any breach may result in immediate suspension of the account without refund, without prejudice to any legal proceedings.

Reporting unlawful content. Any person, whether or not a user of the Service, may report content they consider unlawful or infringing their rights by writing to abuse@streamclipping.ai. Reports should state the URL or identifier of the content, the grounds relied on and, where applicable, the reporter's legal standing. We acknowledge receipt, examine the report diligently and inform the reporter of the outcome. Manifestly unlawful content is removed without delay; the user whose content is removed is informed and may contest the decision at the same address.

6. Intellectual property in content

Your content remains yours. The user retains all intellectual property rights in the content they import (video, audio) and in the clips generated from it.

The user grants us, for the sole duration necessary to provide the Service, a non-exclusive, non-transferable and limited licence to use that content for the sole purposes of: processing by AI models (transcription, virality analysis); generating clips and output files; temporary storage (retention period depending on the plan); and automatic publication to the accounts the user has connected. This licence terminates automatically when the content or the account is deleted. We claim no rights over the generated clips.

This article governs ordinary use of the Service. A clip produced as part of a Campaign is governed instead by Article 5 of the Clipping Program Terms, whose licence is delimited in scope and duration.

User warranty. The user warrants that they hold all necessary rights in the content they submit, and shall indemnify us against any third-party claim in that respect.

7. Third-party integrations

The Service allows users to connect third-party accounts (TikTok, YouTube, Instagram, X, Twitch, Kick) via OAuth 2.0. By connecting an account, the user authorises us to publish on their behalf according to their instructions; acknowledges that they remain subject to each third-party platform's own terms; accepts that we cannot be held liable for a suspension or change of service by those platforms (API changes, account restrictions, moderation of published content); and may revoke the authorisation at any time, which immediately disables future publications to that account.

8. AI output

The Service uses artificial intelligence models. The user acknowledges that transcriptions, clip suggestions, virality scores and generated descriptions are probabilistic estimates that may contain inaccuracies; that final responsibility for published content lies with the user, who is encouraged to review and correct AI output before publication; and that we do not guarantee transcription accuracy or the viral performance of generated clips.

9. Availability and maintenance

The Service is accessible 24/7, subject to maintenance operations, technical incidents or force majeure. We endeavour to anticipate planned interruptions and to carry them out during off-peak hours.

10. Account deletion

The user may delete their account at any time from their dashboard. Deletion entails immediate suspension of access to the Service; erasure of personal data within a maximum of 30 days; retention of legally mandatory records (in particular invoices, for 10 years, for accounting compliance); and cancellation of current subscriptions, without refund of periods already invoiced (in accordance with the Terms of Sale).

11. Amendments to these Terms

We may amend these Terms. Any substantial amendment is notified to the user by email with 30 days' notice, during which the user may terminate their account without penalty. Continued use of the Service does not in itself constitute acceptance of an amended version: acceptance is collected expressly.

12. Governing law and jurisdiction

These Terms are governed by French law. Any dispute shall be submitted to the competent French courts, subject to the mandatory rules protecting consumers. Consumers also benefit from the statutory guarantees provided by articles L.217-3 et seq. of the French Consumer Code and articles 1641 et seq. of the French Civil Code, and from the right of withdrawal set out in Article 6 of the Terms of Sale.
